A significant legislative initiative has been submitted to the State Duma in Moscow, focusing on the prevention of repeat offenses among minors. The proposed bill outlines the implementation of individual preventative measures specifically targeting young individuals who have consistently engaged in illegal activities. These activities include violations against public safety, morality, or property rights, and the full document is now accessible through the Duma`s electronic database.
The initiative was put forth by a group of State Duma deputies. The draft law suggests that these personalized preventative programs for minors should be conducted within facilities managed by the internal affairs bodies, which are dedicated to preventing juvenile delinquency. The scope of offenses covered by these programs is broad, encompassing actions such as discrediting the Russian Armed Forces, promoting Nazi or extremist symbols, acts of assault, violations of anti-drug legislation, and petty theft. The bill stipulates that these preventative efforts would be initiated if a minor commits two or more such offenses within a single year, even if they have not yet reached the age at which administrative responsibility typically commences.
An explanatory note accompanying the bill clarifies its intent, stating: “The proposed legislation aims to empower the Centers for Temporary Detention of Juvenile Delinquents (formerly TSVSNP) with the authority to carry out individual preventative work with referred minors. This includes identifying individuals involved in criminal or socially dangerous activities, detecting instances of cruel treatment, or cases where minors are drawn into committing offenses and antisocial acts, or coerced into suicidal behavior, or subjected to other unlawful acts by third parties. Furthermore, these centers will be responsible for investigating and establishing the circumstances, causes, and conditions contributing to such behaviors.”
Additionally, the bill proposes a name change for the Centers for Temporary Detention of Juvenile Delinquents (TSVSNP), renaming them to `Centers of Internal Affairs Bodies for the Prevention of Juvenile Delinquency.`
The authors of the bill express their conviction that its adoption will play a crucial role in eliminating the root causes and contributing factors that lead to repeated unlawful and antisocial actions. They also anticipate that the legislation will facilitate the restoration of violated children`s rights and foster the development of healthier parent-child relationships.
